By indicating your agreement at the end of this document, you are consenting to assumption of risk, a release of certain legal rights, and other binding terms, except where prohibited by law. If you do not agree, do not participate.
Parties and activities
I wish to participate in or attend pickleball and related athletic, recreational, and conditioning activities, including without limitation open play, leagues, clinics, lessons, tournaments, demonstrations, practice, social events, and use of courts, equipment, parking, walkways, locker rooms, and common areas (collectively, the "Activities") at or through South End Racquet & Health Club (the "Club"). The Club and its affiliates, owners, successors, subsidiaries, officers, directors, managers, members, employees, independent contractors, volunteers, instructors, coaches, referees, agents, sponsoring organizations, and insurers, and the owners and lessors of any premises used for the Activities (collectively, the "Releasees") are intended third-party beneficiaries of this agreement.
Risks
I understand that the Activities are inherently hazardous. Risks include, without limitation: falls, trips, slips, dives, and collisions; contact or impact with the playing surface, nets, fences, walls, posts, doors, glass, dividers, benches, spectators, staff, or other participants; being struck by a ball, paddle, or other object; equipment failure or misuse; musculoskeletal injuries including sprains, strains, fractures, and concussions; overexertion; dehydration; heat-related illness; cardiac, circulatory, or neurological events; illness or complications from communicable disease; damage to or loss of personal property; and motor vehicle incidents in parking or access areas. Such risks may result in temporary or permanent injury, disability, or death. Releasees cannot eliminate all risks or guarantee safety.
Voluntary assumption of risk
I voluntarily elect to participate in the Activities with knowledge of the risks. I assume all risks, whether known or unknown, foreseeable or unforeseeable, that arise out of or relate to the Activities, my travel to or presence at the Club, the condition of facilities or equipment, or the acts or omissions of other persons, including other participants, spectators, or third parties.
Release, waiver, and covenant not to sue
To the fullest extent permitted by applicable law, I hereby release, acquit, waive, discharge, and covenant not to sue the Releasees from any and all claims, demands, actions, causes of action, judgments, liabilities, losses, or expenses (including attorneys' fees) of any kind, whether known or unknown, arising out of or in any way connected with the Activities, my participation or observation, my use of the Club, or travel to or from the Club, including claims arising from the negligence, fault, or omissions of Releasees or others, and including claims for personal injury, illness, death, or property damage. I intend this release to be as broad and inclusive as the law allows. Nothing herein purports to release claims that cannot be released under applicable law (for example, certain claims based on gross negligence or willful misconduct where such limitations apply).
Indemnification
I agree to defend, indemnify, and hold harmless the Releasees from any loss, liability, damage, or cost (including reasonable attorneys' fees) arising out of my participation, my breach of this agreement, my intoxication or use of prohibited substances where applicable, or claims brought by any other person (including a family member or minor) arising out of my conduct or registration.
Medical fitness and insurance
I represent that I am physically and mentally fit to participate and that I will not participate if impaired. I have obtained appropriate medical clearance or I voluntarily assume the risk of participation without it. I understand that Releasees do not provide medical insurance for me. I am solely responsible for any medical, ambulance, or hospital costs, and I am encouraged to maintain health and accident insurance.
Equipment and property
I am responsible for equipment I use or bring. I agree to reimburse the Club for damage to facilities or equipment caused by my reckless, intentional, or grossly negligent conduct.
Emergency care
I consent to emergency first aid, medical treatment, or transport as appropriate. I release Releasees from claims arising from such care except to the extent caused by willful misconduct.
Photo, video, and likeness
I grant the Club a non-exclusive, royalty-free license to capture, reproduce, and use my name, image, voice, and likeness in photographs, audio, or video for operational, promotional, training, or safety purposes, unless I submit a written opt-out where the Club offers one.
Minors
If I register a participant under 18, I am the parent or legal guardian; I enter this agreement on the minor's behalf; I consent to the minor's participation; and I agree to indemnify Releasees for claims brought by or on behalf of the minor.
Rules and conduct
I will comply with all posted rules, session director instructions, and staff directions. The Club may refuse or end participation for unsafe or disruptive behavior.
Governing law and severability
This agreement is governed by the laws of the state in which the Club is located, without regard to conflict-of-law principles. If any provision is held invalid, the remainder remains enforceable to the maximum extent permitted.
Electronic signature
I agree that selecting "I have read and agree" in this RSVP flow constitutes my electronic signature, that I have accessed and may retain a copy of this agreement, and that this agreement is binding.
